Esslinger et al. v. HSBC Bank USA Inc., et al., 10-cv-3213-BMS (E.D. Pa.)

As co-lead counsel, we represented HSBC credit cardholders, challenging the imposition of charges for HSBC’s “payment protection” or “credit protection” program.  The complaint charged that HSBC imposed payment protection without the consent of cardholders and/or deceptively marketed the service, and further that HSBC unfairly administered its payment protection programs to the detriment of plaintiffs and the class of cardholders.  The court approved a $23.5 million settlement with HSBC that also required changes in the marketing and sale of payment protection to consumers.
