Castro, et. al. v. Sanofi Pasteur, Inc., Civil Action No. 11-cv-07178-JLL (D.N.J.)

Plaintiffs charge that Sanofi has used a network of physician buying groups to implement a web of anticompetitive product bundling agreements.  These anticompetitive agreements have allowed Sanofi to maintain and increase its monopoly power in various pediatric vaccine markets, which in turn allows Sanofi to charge artificially-inflated prices for multiple pediatric vaccines.  In July 2012, Plaintiffs defeated Sanofi’s motion to dismiss, won a motion to strike Sanofi’s counterclaim, and turned back Sanofi’s motion to stay discovery.  Plaintiffs’ class certification motion is currently pending.
